Placing an order
- Every product page describes what you are buying. Fresh flowers are seasonal: photos show the style of an arrangement, not the exact stems (see "Substitutions").
- Your order is an offer to buy. It is accepted when payment is confirmed and we email your order confirmation. If we cannot fulfil an order we have accepted, we contact you and refund what you paid in full.
- Before you pay, the checkout shows every item, the delivery fee, any discount, the VAT included and the total, and lets you correct your details.
- One discount code per order. A code cannot be exchanged for cash.
Prices and payment
- Prices are in South African rand and include VAT at 15%.
- Delivery is charged by road distance from our shop — R95 for the first 5 km, then R15 for each further kilometre or part of one, VAT included — and shown before you pay. Every order has a minimum of R500, whether it is delivered or collected.
- Payment is taken by PayFast on PayFast's own secure pages. We never see or keep your card details. You can pay by card or Instant EFT, or any other way PayFast offers on its page.
- A price shown wrongly because of an obvious error does not bind us; we will contact you before fulfilling the order, and you may then cancel it for a full refund.
Delivery and collection — in short
The full rules are on our Delivery & Returns page. In short:
- Our own driver delivers, up to 50 km by road from the shop; we do not use couriers.
- Delivery Monday to Friday, between 09:00 and 16:30 on the day you choose (there is no time window to choose). No deliveries on Saturdays, Sundays or public holidays.
- Same-day delivery to Stellenbosch, Bottelary, Klapmuts, Somerset West, Strand, Gordon's Bay, Paarl and Franschhoek for orders placed before 12:00 on a working day. Everywhere else on Wednesdays only, ordered by 17:00 on the working day before.
- Collection from the shop, 44 Ryneveld Street, on working days.
- If nobody is home, the driver phones the recipient. If we still can't deliver, the flowers come back to the shop and we let you know. We'll then deliver once more (the delivery fee applies again) or arrange for the recipient to collect from the shop. We make only one further delivery attempt. We don't leave flowers with a neighbour, reception or security unless you asked us to. The same applies if the address or phone number we were given is wrong.
- Some items need more notice (wreaths: two working days).
Substitutions
If a flower is not available, we use similar flowers of equal or higher value, keeping the style and colours you chose.
Changes and cancellations
You can change or cancel an order up to 4 working days before the delivery or collection date, for a full refund of what you paid, returned through PayFast to the way you paid. After that the flowers have been bought in for your order and it cannot be changed or cancelled. This does not take away any right the Consumer Protection Act gives you.
Cooling-off. ECTA gives a seven-day cooling-off right for many online purchases, but not for goods made to your specification or that are likely to deteriorate rapidly, such as fresh flowers (ECTA s42(2)). Gifts and other stock items (cards, treats, vases, candles, tools) may be returned unused, in their original packaging, within seven days of delivery for a refund.
Quality complaints
Tell us within 24 hours of delivery, with a photo. If the flowers are not right, we replace them or refund you. This does not take away any right the Consumer Protection Act gives you.
Your record of the order
We email a confirmation of every order with what you bought, the delivery details and the total paid. If you have an account, your orders are listed under Account → Orders. Please keep the email; we can send you a copy of it on request.
Your privacy and payment security
How we handle personal information is in our Privacy policy. Card payments are made on PayFast's pages over an encrypted connection; we do not receive or store card numbers. The whole site is served over HTTPS.
Liability
Nothing in these terms limits or excludes any right you have under the Consumer Protection Act or any other law, or our responsibility for loss caused by our gross negligence. Subject to that, we are not responsible for a delay or failure caused by something outside our reasonable control (for example severe weather, road closures or power cuts) — we will contact you and agree another date, or refund you — and our responsibility for an order is otherwise limited to what you paid for it.
Using the site
The photographs, text and designs on this site belong to Flowers in the Foyer or are used with permission; please do not copy them for any commercial purpose without asking us. Please do not use the site unlawfully or in a way that harms it or its other visitors. Links to other services (WhatsApp, Instagram, Facebook, PayFast, Google Maps) take you to sites we do not control, which have their own terms.
Law, and changes to these terms
These terms are governed by the law of the Republic of South Africa. Nothing in them takes away your right to approach a consumer court, the National Consumer Commission or any other forum the law gives you. We may update these terms; the version on the site when you place your order applies to that order.
Gift vouchers
- A gift voucher is for an amount in rand, to spend in our shop. It is valid for 3 years from the date it is issued.
- Vouchers are redeemed in our shop at 44 Ryneveld Street, Stellenbosch, until we can accept them on this website. When that changes, these terms will say so.
- A voucher can be used in parts: what is left stays on it for the rest of its 3 years.
- A voucher cannot be exchanged for cash, and what is left on it is not paid out.
- Cooling-off. An unused voucher bought on this website can be cancelled within 7 days of purchase for a full refund, returned through PayFast to the way you paid. After that it cannot be refunded.
- Every voucher has a code, recorded in our voucher register. A lost voucher is replaced only if its code can be verified on our register, so please keep your order confirmation and the voucher's code.
